问：法律规定关于实践操作不一致时，如何能既解决客户的实际问题，又能控制律师执业的风险？

Q：When practical operation does not in accord with legal regulations, how can a lawyer solve client's real problem, and control legal risks while practising law?

面对此类问题，首先要分析客户面临的最大法律风险，要判断出最坏的结果会是什么。
For this question, firstly, we should analyse what is the most serious legal risk that the client is facing with, and predict what the worst result will be.
其次，针对法律条文的具体操作，律师要尽力通过各种合法的途径检索对有争议条文的解释及相关主管机关的答复。
Secondly, lawyer should try his/her best to search appropriate explainations for the controversial legal provisions, seek replies from the relevant authorities, by means of all legal approaches.
最后，仍要向客户指明该问题仍为敞口问题，待进一步查证，进而交由客户进行商业上的判断。
At last, lawyer should point out that this problem is still an open issue, which is remain to be verified. Then, it should be left to the client and let client to make a commercial judgement.
同时，律师还要指导客户，针对此类实践操作与法律规定并不一致的情况，客户一定要确保自己的行为的合法性，包括客户向主管机关提交的文件的真实性、准确性，不能存在任何隐瞒和瑕疵。总之，要尽可能地降低客户的风险。
In the meanwhile, lawyer should instruct his/her client. When practical operation does not in accord with legal regulations, client must make sure that his/her behavior is legal, including delivering real and accurate document to relevant authorities, no concealment and blemishes.
然而，当客户的要求明显违法，甚至涉及刑事责任，律师要坚决拒绝此类业务。这也是律师执业的一个最基本的原则。
However, when it is obviously an illegal request, or even involves criminal liability, lawyer must reject such request firmly. This is the basic principal of legal practices.
