President Biden and his advisers are hoping to take executive action on the issue befoer or coinciding with his March 7 State of the Union address to show the president is moving ahead after Republicans killed a bipartisan border aggrement in the Senate.

The primary action under consideration is a ban on migrants who cross the border illegally from claiming asylum, allowing them to be quickly deported back to Mexico or their home countries.

The ban would be intended to mimic a measure in the Senate agreement that would have allow the government to "shut down" the border and expel migrants if crossings surpassed a daily threshold of 4,000. People familiar with the matter said the ban could be justified using a section of the Immigration and Nationality Act. It is possible, the people said, that the ban could be tied a similiar trigger mechanism as the one negotiated in the Senate bill.
