According to the provisions of Tort Liability Law, for damage caused by any person without the capacity of civil conduct or with limited capacity of civil conduct, the guardian shall bear tort liability.

根据侵权责任法的规定，对于因无民事行为能力人或限制民事行为能力人侵权行为所造成的损失，其监护人应承担侵权责任。

If the guardian has fulfilled his guardian duties, his tort liability may be mitigated.
